· About these terms
These Terms of Sale govern your purchase of goods from Magnetic Motorsports ("we", "us", "our"). In these terms, "you" means the customer. By placing an order, you accept these terms. They should be read together with our Product Warranty and, where you engage our conversion service, our Conversion Service Terms.
We may update these terms from time to time. The terms in force at the time you place your order apply to that order.
· Intended use — off-road / competition only
Goods supplied by Magnetic Motorsports are sold for off-road, recreational, and competition use only, and are not sold as compliant with any requirement for use on a public road. It is your responsibility to ensure any product, modification, or conversion is engineered, certified, and made road-legal in accordance with the laws of your state or territory before any on-road use. Engine conversions and many modifications require certification by an approved engineering signatory (such as VASS, VSCCS, or a state-equivalent Approved Person) to be road-legal, and obtaining that certification is your responsibility.
International customers. For customers outside Australia, road-construction, modification, registration, and engineering-certification requirements differ in every country. Magnetic Motorsports makes no representation that any product is road-legal, compliant, or certifiable in any jurisdiction outside Australia, and accepts no responsibility for road use or engineering compliance outside Australia. Determining and meeting all applicable local requirements before any on-road use is entirely your responsibility. Our product warranty (see the Product Warranty) applies worldwide regardless.
· Products, descriptions and pricing
We try to ensure product descriptions, images, specifications, and prices are accurate and current, but we do not warrant that all information is error-free. Images may be illustrative and may differ from the actual product.
Prices are in Australian dollars and exclude GST unless stated otherwise. In the event of a pricing or description error, we reserve the right to correct the error and, before dispatch, to amend or cancel your order with a full refund of any amount paid. Product availability may change without notice.
· Product specifications and compatibility
Product specifications and compatibility may change over time. It is the customer's responsibility to confirm a current product suits their specific application before purchase, and Magnetic Motorsports is not liable for incompatibility arising from design or material changes to superseded products.
Where a product has been superseded, discontinued, or can no longer be produced to its original specification, appearance, or materials (for instance, where the original material is no longer available at the required quality or finish), the current version may differ from earlier versions. While we endeavour to maintain backward compatibility, we do not guarantee that a current or updated product is compatible with an existing setup based on an earlier version.
· Orders and made-to-order goods
Many of our products are made to order; Made-to-order items are typically assembled within 3 business days and dispatched within 10 business days. Lead times are estimates, not guarantees, and may vary with order volume and materials availability.
Because made-to-order and custom items are produced specifically for you, they are not eligible for change-of-mind return — see Section 7.
· Payment, shipping and delivery
We accept payment by credit and debit card, PayPal, and Shop Pay.
Title to and risk in the goods: risk passes to you on delivery to you or your nominated carrier; title passes once payment is received in full.
Shipping costs and estimated delivery times are as shown at checkout or as quoted. Delivery timeframes are estimates and are not guaranteed. We ship both within Australia and internationally. For international orders, any import duties, taxes, or customs charges are the responsibility of the customer.
· Change-of-mind returns
Change-of-mind returns are separate from your rights for faulty goods (Section 8) and from warranty claims (see the Product Warranty).
Stocked / off-the-shelf items.
Regularly stocked, off-the-shelf items may be returned for change of mind within 7 days of delivery for a full (100%) refund of the product price, provided the item is returned in undamaged, unused condition with no marks, scratches, or wear of any kind and with all original packaging. Any marks or damage, including any arising from trial-fitting, render the item ineligible for change-of-mind return (see the Product Warranty for trial-fitting). The customer is responsible for arranging and paying for return shipping, and bears the risk of the goods in transit — please use a tracked, insured method, as we are not responsible for goods lost or damaged on the way back to us. Original outbound shipping is not refunded.
We strongly recommend photographing the product and its packaging on arrival, and again before return, as evidence of condition.
One-off, custom-made, and special-order items.
Because these are produced specifically for you, they are not eligible for change-of-mind return or refund.
Discretionary resale assistance (custom items).
As a courtesy, and entirely at our discretion, we may assist you in offering an unwanted custom item to other customers — such as by making it known to our customer base or listing it. This is a goodwill gesture only: we do not guarantee that a buyer will be found, do not guarantee any price or timeframe, and are under no obligation to achieve a sale. Any such sale is a matter between you and the eventual buyer.
To request a change-of-mind return, contact us at admin@magneticmotorsports.com for a Return Merchandise Authorisation (RMA) number before sending anything back.
· Faulty goods and your Australian Consumer Law rights
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
‘Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.’
If you believe goods are faulty, contact us at admin@magneticmotorsports.com with your proof of purchase and details of the fault. Faulty-goods claims are handled under the process in our Product Warranty.
· Limitation of liability
To the extent permitted by law, and subject to Section 8:
– Our total liability for any product is limited, at our option, to repairing or replacing the product, supplying an equivalent product, or paying the cost of doing so.
– We are not liable for any indirect, consequential, or incidental loss or damage, including loss of use, installation or removal costs, labour, towing, vehicle downtime, loss of profit, or damage to other components or the vehicle.
– We are not liable for loss, damage, or injury arising from on-road use of goods supplied for off-road/competition use, or from installation, modification, or use not in accordance with our instructions.
Nothing in this section excludes any right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
· Intellectual property
All content on our website and in our materials — including text, images, logos, designs, and product photography — is owned by Magnetic Motorsports or its licensors and is protected by copyright and other laws. You may not copy, reproduce, or distribute it without our written permission.
· Customer-supplied media
Where a customer sends us photographs, videos, or other media — for example images of an installed CANbus module, harness, or completed conversion in the customer's vehicle — the customer grants Magnetic Motorsports permission to use that media for promotional and marketing purposes, including on our website, social media, and other materials.
We will not publish personal identifying details (such as number plates or the customer's name) without consent, and will make reasonable efforts to obscure them where practical. If you do not want your media used, simply tell us in writing at any time, and we will not use it, or will cease using it and remove it from materials we control where reasonably practicable. This permission is non-exclusive and royalty-free, and does not transfer ownership of your media to us.
· Governing law
These terms are governed by the laws of Queensland, Australia, and you submit to the courts of that jurisdiction.
